Motion to Suppress Firearm and Statements GRANTED

Attorney Melissa Thomas successfully argued a Motion to Suppress today resulting in her client walking free. Police stopped the defendant's vehicle because of improper tags on his vehicle. When they approached him, police started repeatedly questioning him about the presence of a firearm without advising him of his Miranda Rights. Police then took him out of the vehicle and continued to ask him if there was a gun in the car. Eventually, he told police there was a gun inside of a backpack in the backseat. Police then went into the car and frisked the backpack where the officer testified he could feel a gun inside. They obtained a search warrant and recovered the gun from inside the bag. The entire incident was captured on police body cam.

 

The Court found that police should have advised the defendant of his right to remain silent before answering any incriminating questions. The Court also found that police did not have probable cause to obtain a search warrant to search the car because their methods were illegal and unconstitutional. The Court granted Attorney Melissa Thomas' Motion to Suppress and excluded the statements made by the defendant and the search of the vehicle. This client was facing multiple years of incarceration, but walked out of the courtroom today free thanks to Attorney Thomas' efforts.
